# NOUS CINEMA — Terms of Service

By using NOUS CINEMA ("Nous," "the App"), you agree to these Terms of Service. If you do not agree, please do not use the App.
## 1. About the Service
Nous is a movie discovery app that helps individuals and groups find films to watch together. Users swipe through curated selections, vote on favourites, and receive personalised recommendations based on streaming availability in their country.
## 2. Eligibility
You must be at least 13 years old to use Nous. By using the App, you confirm that you meet this age requirement.
## 3. Your Account & Sessions
Nous does not require account creation. Game sessions are temporary and stored in memory on our servers. Session data (votes, preferences, room codes) is not permanently retained and may be lost if the server restarts. We make no guarantee of session persistence.
## 4. In-App Purchases
Nous offers an optional premium upgrade ("Nous Premium") available as a one-time in-app purchase. This purchase removes advertisements and unlocks additional viewing profiles.
- All purchases are processed by Apple (App Store) or Google (Google Play) and are subject to their respective terms and refund policies.
- To request a refund, contact Apple or Google directly through their standard refund process.
- You may restore previous purchases at any time using the "Restore Purchases" option in the App's settings.
## 5. Acceptable Use
You agree not to:
- Use the App for any unlawful purpose
- Attempt to disrupt, overload, or interfere with the App's servers or infrastructure
- Reverse-engineer, decompile, or attempt to extract the source code of the App
- Use automated tools, bots, or scripts to interact with the App
- Impersonate another person or misrepresent your identity
## 6. Content & Third-Party Data
Film information, posters, synopses, ratings, and streaming availability displayed in Nous are sourced from third-party providers including JustWatch. This data is provided for informational purposes only.
- We do not guarantee the accuracy, completeness, or timeliness of film data or streaming availability.
- Streaming availability may change at any time and may differ from what is displayed in the App.
- Film content may include mature themes. Nous is rated 13+ and parental discretion is advised.
## 7. Intellectual Property
The Nous name, logo, design, and original code are the property of Belmore Pictures. Third-party content (film data, posters, trademarks of streaming services) belongs to their respective owners and is used under licence or fair use for informational display.
## 8. Newsletter
If you subscribe to the Nous-Letter, your name and email address are shared with our email provider (Brevo) solely for the purpose of delivering the newsletter. You may unsubscribe at any time.
## 9. Privacy
Your use of Nous is also governed by our [Privacy Policy](https://belmorepictures.com/nous-privacy-policy), which describes how we collect, use, and protect your information.
## 10. Disclaimers
The App is provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not warrant that the App will be uninterrupted, error-free, or free of harmful components.
To the fullest extent permitted by law, Belmore Pictures shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App.
## 11. Changes to These Terms
We may update these Terms from time to time. Continued use of the App after changes are posted constitutes acceptance of the revised Terms. We encourage you to review this page periodically.
## 12. Termination
We reserve the right to suspend or restrict access to the App at any time, for any reason, without notice.
## 13. Governing Law
These Terms are governed by the laws of Australia. Any disputes arising from these Terms shall be resolved in the courts of New South Wales, Australia.
